Welcome to Ryker Ranch LLC and our Terms of Use and Conditions of Purchase (these “Terms”).

THESE TERMS ARE IMPORTANT AND AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY BEFORE PLACING AN ORDER.

By accessing or using the services provided by Ryker Ranch L.L.C., or our subsidiaries or other affiliates (collectively, “Ryker Ranch LLC,” “we,” “us” or “our”) through our websites, blogs and/or mobile applications (collectively, the “Sites” and together with such services, the “Services”), you agree to be bound by these Terms and all terms incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services or order, receive, or use the meat or other products made available through the Services (collectively, the “Product(s)”).

We reserve the right to modify these Terms at any time and in our sole discretion. If we change these Terms, we will provide notice through the Sites. By continuing to access or use the Services after such notice, you confirm your acceptance of the revised Terms. If you do not agree, you may not access or use the Services or order, receive, or use the Products.

1. Eligibility

By using the Services, you represent and warrant that you:

Are 18 years of age or older;
Are a legal resident of the United States;
Have not been previously suspended or removed from the Services, or engaged in any activity that could result in suspension or removal; and
Have full power and authority to enter into these Terms and in so doing will not violate any other agreement to which you are a party.

2. Registration, Account, and Communication Preferences

To use certain areas of the Sites, you must register for a Ryker Ranch LLC account. By creating an account, you agree to:

Provide accurate account information.
Maintain and update your account information as needed.
Keep your password secure and accept all risks of unauthorized account access.
Immediately notify us if you discover or suspect any security breaches related to your account or the Services.

By creating a Ryker Ranch account, you also consent to receive electronic communications from Ryker Ranch (e.g., via email or by posting notices on the Sites). These may include notices about your account (payment authorizations, password changes, and other transactional information) and promotional communications (special offers, surveys, and other news). You may opt out of promotional emails at any time using the unsubscribe instructions provided in those emails.

3. Use of the Sites and Content

Unless otherwise indicated in writing, the Sites and all content, including designs, text, graphics, images, information, data, software, and the selection and arrangement thereof (collectively, “Content”), are the proprietary property of Ryker Ranch or our licensors. In addition to any other prohibitions set forth elsewhere in these Terms, you are prohibited from using the Services or Content:

For any unlawful purpose or to solicit others to perform unlawful acts;
To violate any regulations, rules, or laws;
To infringe upon our intellectual property rights or the rights of others;
To harass, abuse, insult, harm, defame, slander, or discriminate;
To submit false or misleading information;
To upload or transmit viruses or malicious code;
To collect or track personal information of others;
To spam, phish, pharm, pretext, spider, crawl, or scrape;
For any obscene or immoral purpose; or
To interfere with or circumvent the security features of the Services or Sites.

Any use of the Sites or Content outside of what is specifically authorized here is strictly prohibited and may violate applicable laws. We respect your right to privacy. For details on how we collect and use personal information, please see our Privacy Notice.

4. Terms of Sale

4.1 Product Offerings

Our Products are offered exclusively online through our Sites, may have limited quantities, and are subject to return or exchange only in accordance with our Return Policy. We reserve the right, but are not obligated, to limit sales of our Products to any person, geographic region, or jurisdiction on a case-by-case basis.

4.2 Pricing and Availability

All prices shown via the Services are in U.S. dollars. Any applicable taxes and other charges are additional. Product availability is described on our Sites at the time of purchase and is subject to change. We reserve the right to change our Product offerings and adjust prices at any time and without notice. The shipment of Products to you after we deliver notice of changes confirms your acceptance of such changes.

4.3 Payment and Billing Information

By using the Services, you represent and warrant that you are authorized to use the designated payment method for any purchase and that you authorize us (or our third-party payment processor) to charge your payment method for all charges (including applicable taxes and other charges) related to your order (each such purchase, an “Order”). You are responsible for all such charges.

4.4 Shipping and Handling

You agree to pay any shipping and handling charges shown at checkout. We reserve the right to modify such charges but will provide notice before you complete your purchase.

4.5 Deliveries

You are responsible for inspecting all Products for damage or other issues upon delivery. We do not guarantee that Products will arrive frozen, but we use methods (dry ice, gel packs) to help preserve condition. If you intend to consume the Product more than a few weeks from delivery, we suggest using expedited shipping. You alone are responsible for determining the freshness of the delivered Products and their proper storage, preparation, cooking, and consumption. 4.6 Return Policy

Because of the perishable nature of our Products, Ryker Ranch does not accept returns. If an item is damaged in transit, please contact us at rykerranchbeef@gmail.com or (405) 274-2560, so we can investigate.

5. Trademarks

“Ryker Ranch,” the Ryker Ranch logo, and any other Product or service names, logos, or slogans that appear on the Sites or Products are trademarks of Ryker Ranch and may not be used without permission. All Content is protected by U.S. and international intellectual property laws and treaty provisions. No rights in any Content, including any trademark or service mark, are granted to you through your use of the Services. Ryker Ranch and its affiliates and licensors expressly reserve all intellectual property rights in the Content.

6. Hyperlinks

The Sites may include materials or links to third-party websites. We do not endorse and are not responsible for examining or evaluating third-party content, materials, products, or services. We will not be liable for any harm or damages related to these third-party resources. Review each third-party’s policies and practices before engaging in any transaction with them. Complaints or questions regarding third-party products should be directed to the third party.

7. Third-Party Services

7.1 Generally

Third-party providers collect, use, and disclose your information only to the extent necessary to allow them to perform services for us. However, certain third-party providers (payment gateways, transaction processors, etc.) have their own privacy policies regarding your information. We recommend reading their privacy policies to understand how your information will be handled. When these providers are located or have facilities in a different jurisdiction, your information may be subject to the laws of those jurisdictions.

8. Feedback

You may submit questions, comments, suggestions, ideas, or other information about Ryker Ranch, the Sites, or the Products (collectively, “Feedback”). Feedback is non-confidential and becomes the sole property of Ryker Ranch, which may use the Feedback without acknowledgment or compensation to you.

9. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Ryker Ranch and our employees, officers, directors, equity holders, service providers, affiliates, agents, representatives, successors, and assigns (collectively, the “Ryker Ranch Parties”) from and against any claims, damages, losses, liabilities, or costs (including attorneys’ fees) arising out of or related to (i) your use of the Sites, (ii) your violation of these Terms, or (iii) any materials you post or transmit through the Sites.

10. Disclaimers

ALL INFORMATION, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH OUR SITES ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, RYKER RANCH, ITS SUBSIDIARIES, AND AFFILIATES DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY INFORMATION OR CONTENT ON THE SITES AND DO NOT WARRANT THAT THE SITES WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

11. Limitation of Liability; Release

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RYKER RANCH AND THE RYKER RANCH PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THE ACCESS OR USE OF THE SITES, CONTENT, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF SUCH DAMAGES.

12. Termination

The obligations and liabilities incurred prior to the termination date survive termination of these Terms. These Terms remain effective unless and until terminated by you or us. You may terminate by notifying us you no longer wish to use our Services or by ceasing use of the Sites. If, in our judgment, you fail (or we suspect you have failed) to comply with these Terms, we may terminate them at any time without notice, and you remain liable for all amounts due up to the date of termination.

13. Survival

Sections 5 through 11 and Sections 13 through 15 survive the expiration or termination of these Terms and your Ryker Ranch account.

14. Governing Law and Venue

These Terms, your use of the Sites, and your order, receipt, and use of Products shall be governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute shall be resolved in the state or federal courts located in McClain County, Oklahoma.

15. Severability

If any term, clause, or provision of these Terms is deemed invalid or unenforceable, it shall be severed, and the remaining provisions remain valid and enforceable.

16. DMCA Notice

If you are a copyright owner or an agent thereof and believe any Content on the Sites infringes upon your copyrights, you may submit a written notice pursuant to the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”). Send notices of infringement to contactus@rykerranchbeef.com with the following:

An electronic or physical signature of the copyright owner or the authorized person.
A description of the copyrighted work you claim has been infringed.
A description of where the infringing material is located on the Sites.
Your address, telephone number, and email address.
A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or law.
A statement, under penalty of perjury, that the information in your notice is accurate and you are the copyright owner or authorized to act on the copyright owner’s behalf.

17. Miscellaneous

These Terms constitute the entire agreement between you and Ryker Ranch relating to your access to and use of the Sites and your order, receipt, and use of Products. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without Ryker Ranch’s prior written consent. No waiver of any provision of these Terms constitutes a waiver of any other provision. Except as otherwise provided, these Terms are for the sole benefit of the parties and do not confer third-party beneficiary rights.
